Jokes aside, as said above, DMCA take downs are extremely rare, and usually only happen with very possessive companies. Songs are very unlikely to be DMCA'd if credit is given.

That doesn't mean you're permitted to use it, strictly speaking. Yes, your project probably won't be taken down as long as you give credit. But there is a nonzero chance that it could be removed, and so it would not be a good idea to suggest that you are allowed to use such music.

Aside, Robtop used it like 10 years ago but DMCA probably didn't exist.

yes but artists rarely do that, and the amount of project that use that audio would be far too many

Scratch's copyright system doesn't work like YouTube's. So, yes. You need to give credit, though.
