For one, the CG is vague (and is meant to be vague). TOS isnt supposed to be vague (and isn't supposed to rely on anything).
the terms of use are supposed to contain all the information about the use of scratch, and the CG is nothing more than a community interpreter for it.
The current ToS says that it includes “Additional Terms” and it gives a very vague description on where that might be found. It can be anywhere on the page and it can also be on other pages. (and I think it also includes the Community Guidelines)
Additional Terms.
Your use of the Service is subject to all additional terms, policies, rules, or guidelines applicable to the Service or certain features of the Service that we may post on or link to from the Service (the “Additional Terms”). All Additional Terms are incorporated by this reference into, and made a part of, these Terms.
thats a bit of a problem with the ToS(, which is also a reason it should be changed)

Re-rewrite the Terms of Service

For them to change the Terms of Service is a legal process. They can’t just go hopping around changing things as they please. It doesn’t work that way. And something being short isn’t always the best way. It’s long for a reason. They have to include all of the rules and regulations and a description of them. Without the added length, how would people decipher it in a situation?

Take this scenario, for example:
A store has a policy that you can’t move items around on the shelves. But they don’t explain what “move” could be. So, if someone just nudges an item with a feather, would that be against store policy?
You see, without the extra details and description, it’s hard to tell what something might mean.

And about the AI. The only way that Scratch would be able to prevent companies from training AI on the site would be to prevent crawlers. I know that a few companies have done that. But one problem with that is the fact that the site couldn’t be archived, since a crawler is needed to do that.
And it’s not like the AI companies would be okay with this happening. They’d probably dislike it.
At this point, we just have to live with AI. There’s no need to complain. You can choose to not use it, but that doesn’t stop anyone else from using it. And it doesn’t stop the AI companies either.

Yes, I know that. I was just saying.

And do you have anything to say regarding the rest of my post?

True, but that doesn't mean they can't change it. As @codubee once said, ‘Orgs change ToS’s all the time.'

True. Do you have any specific feedback on the drafts?

Indeed, but the current ToS is also, at least in part, designed to prevent third-party training

I don’t, actually. The most recent draft you’ve written looks pretty good. It’s short, concise, and makes sense.

But maybe you should report the topic and request a moderator to take a look.

2.19:
Don't use user-generated content (as defined in 3.2) for training AI models.
