Inconsistency in Legal Info
In the Terms of Use it states
5.4 The Scratch name, Scratch logo, Scratch Day logo, Scratch Cat, and Gobo are Trademarks owned by the Scratch Team. The MIT name and logo are Trademarks owned by the Massachusetts Institute of Technology. Unless you are licensed by Scratch under a specific licensing program or agreement, you may not use these logos to label, promote, or endorse any product or service. You may use the Scratch Logo to refer to the Scratch website and programming language.
However, the FAQ says
May I use / remix Scratch support materials, sprites, images, sounds or sample projects I’ve found on the website?
Yes: Most Scratch support materials on the Scratch website are available under the Creative Commons Attribution-ShareAlike license. There are a few exceptions: the Scratch Logo, Scratch Cat, Gobo, Pico, Nano, Giga, and Tera are Scratch trademarks, and can not be used without explicit permission from the Scratch Team.

The whole terms of use is in a state. It’s also illegal to post anything unconstructive or post projects using the 3.0 offline editor. I think overall it just needs a big revamp which includes a careful checkover. Scratch really needs to take more care of TOU - it’s a legal document, after all.

Dang why aint this fixed yet?!!?I doubt the Scratch Team has seen this. And if they did, they probably just ignored it like the other topics. But if that's the case, then they are probably making their descison.

Sure, this is a good idea, though I do raise a new question. Does this mean other default sprites such as Abby, Jaime, and/or Wizard-a aren't included?

The reason for this is probably because the terms of use was updated in 2016 while the FAQ was updated more recently.

coming back here, it's also worth pointing out that it should be changed that legally you can only use scratch 1.4 in the tou, so maybe everything needs a thorough review?
