Hi,

I saw a project of an interpretation of the new ToS and the creator claimed that the ToS said:

• We can no longer used copyrighted music and characters (including fanart???) even with credit ???
  

• We can no longer use browsers (Chrome, Safari, etc.) to use Scratch ???
  

Are these true or misinterpreted? If they are misinterpreted, what do they actually mean?

As for browsers, no way that's true whatsoever.

I think it meant things to attack the site and stuff.

the 1st makes since because of DMCA (which scratch MUST inforce).This act basically does not allow work to be shared even with credit.

That's just because in order to be able to grant other users the ability to use or remix your project, any other material you use in it also needs to allow that, and the new Terms of Service are explicitly stating that. It's the same reason you can't mindlessly put a copyrighted artwork on your own shirt and do whatever you want with it.

This may have also been the case before when CC BY-SA 2.0 license terms were applied to projects (but instead with content compatible with those license terms), if not for the fact that at that time there may have been a loophole that allowed you to say that you only needed to apply CC BY-SA 2.0 terms to your own content and not the entire project, meaning projects could be a mix of material licensed under both CC and non-CC terms.

That's an all time low for Scratch, in my opinion.

Wait, you used to be allowed to use music if you gave credit and it wasn't the main point of the project
Has that now changed :/ (I made a project I was planning to share on an alt with Pokemon music and the music wasn't the main focus of the project and it was credited)

To sum it all up, essentially, depending on how you interpreted the old TOS, you only had to apply a license to your own content, but now you have to apply the license to your entire project (which you can't do if the material you use doesn't allow that).

so pretty much make nothing based on what you love? i don't think a kid is going to the rights from big companies AND NINTENDO SURE AIN'T GIVEN THE RIGHTS TO NO ONE they have proven how they are with fan stuff time and time again

Edit: From the replies…fan games and fan art are not allowed anymore as far as we know. Many creators including myself are and will be upset about this. Implementing this change of no fan projects will hide the work of thousands of creators and prevent creators from expressing their true creativity through their interests. Also, can you even use Scratch online without a browser? There's no way browsers are banned…

I am unsure about the browsers thing, it's probably false. So far, the fan project thing is true, sadly. Unless an ST member comes and renders it false.
