if you know nintendo well, then they'll probably try their best to take it down. however afaik scratch doesn't have these types of issues (99% sure i am wrong, but you can still google it just to be sure). so you should be fine.

Wait is Nintendo perhaps more “aggressive” when it comes to Pokemon compared to Mario? Initially I would think “If many Mario games here exist, then there is not much risk in making Pikachu games either.”

You can, but be careful, as the Nintendo lawyer ninjas will probably sue you. But if you're underage or if you think the game is too bad to be popular, then yeah i think it's okay.

(note if you hypothetically win a lawsuit against nintendo for a fangame they will appeal it and by appealing i mean bribing the judge)

Eh, I've seen a bunch of fangames last for quite a while. They haven't taken down SMBX (and smbx2), and that's much bigger and older than the average scratch project.

Doubtful they would even try to sue you, because it can be protected by Fair Use. Also, no one has ever been sued from using copyrighted material on Scratch. Worst that happens is a DMCA takedown, which means it just gets taken down. No legal action taken. Anyway, only two DMCA takedowns have been made public.

There is no copyright on scratch, any scary Pokemon games or pikachu games will be taken down by S.T and not Nintendo as they can't do stuff like that, only on roblox and other platforms.
