Important: Kids’ Privacy and Online Safety - Restrict Underage Users
mistakes are essential to learn
if you don't make mistakes, you can't learn.
Also, mind specifically mentioning what law in America exists that could create a lawsuit against Scratch in general? Scratch is better than most platforms at applying to the Children's Online Privacy Act (COPPA), even if there's slipping through cracks they are doin' the best they can, which despite me being a Hungarian with a bit too much freetime on their hands, looks like they abide by it enough from what I can tell, then again I'm no lawyer.
In general, this is actually just age restriction from what I can understand.
I mean, restrict comments, etc etc. That's restriction to a certain age, however it doesn't neccasarily matter as this is actually not even enforcable without making few people feel like they are being pry-ied into just for a check if they are underage or not.
Also, I'm one of the people who did do dumb stuff when I was younger, I learnt from it and now i'm loads different, again, if you can learn from mistakes, and it isn't reading a thing a few billion times to memorize it, you are learning that you should NOT do dumb things, which is essential.

EDIT: Also, what about student accounts for example?

That is true, and it pretty much defeats the whole purpose of using Scratch if you aren’t allowed to share with others around the world your creations.You could still love & fav & remix, but you wouldn’t be able to shareThat would break the motto imagine, program, share

To put it simply, this is a kid's site. Removing functionality for under-13s would go against scratch's principles and goals. Besides, Scratch doesn't need to restrict underage users because it isn't governed by COPPA due to its nature.
Additionally, I'm pretty sure that this suggestion could potentially fall under TOLORS 7.2, so I doubt it's going to even be considered for implementation.

Knowing the actual age of a Scratcher is an inexact science at the moment. Currently, there is no age verification. So a drastic restriction such as you propose will likely result in a lot more incorrect age accounts on the site.
Also, if one of your major concerns is exposure of young Scratchers to inappropriate material - that isn't affected by removing their ability to share stuff (unless you are making the argument that a large percentage of the inappropriate material is generated by younger Scratchers? I have seen no data to support that.)
Your concerns are valid - but I'm not convinced that the suggestion addresses them adequately or allows Scratch to fulfill it's mission.
