It is legal unless you're using it to play pirated games.
That means, digital exclusives are lost if you are a law-abiding citizen. If you arr a pirate, that changes.
I bought lots of games legally off the eShop (both on 3DS and Wii U) to commemorate its legacy where does that put me
Law-abiding citizen.
As DifferentDance8 said, we should not talk about stuff that may get us in legal issues, such as piracy.

It's still illegal
it probably shouldn't be but that's how they build up nostalgia for rereleases or ports
except Nintendo doesn't rerelease their games anymore!!
nso doesn't count in my opinion since it's an outdated subscription service that doesn't even have GameCube
and every library besides nes and snes is way too small

Yes, because when you pirate games that can no longer be bought for reasonable prices, Mario himself will break into your house, turn you into a goomba, and then jump on you

And if after all these years you still don't ever bother watching it, he might as well personally break into your house and make you go to hell before you die. Talking of which, that's exactly how i feel whenever i play 3DS Sonic Lost World.

yeah, if you commit piracy however, mario will break into your house, turn you into a koopa, and then jump on you, completely different.

Is It Okay to Copy or Download Older Titles That Are No Longer Sold?
No, the current availability of a game in stores is irrelevant as to its copyright status. Copyrights do not enter the public domain just because they are no longer commercially exploited or widely available. Therefore, the copyrights of games are valid even if the games are not found on store shelves, and using, copying and/or distributing those games is a copyright infringement.

While we recognize the passion that players have for classic games, supporting emulation also supports the illegal piracy of our products. Wherever possible, Nintendo and its licensees attempt to find ways to bring legitimate classics to current systems (via Virtual Console titles, for example).

yes, if the physical copies (or any official digital ports) of a game either no longer exist or are not being sold on ebay or something similar, then it is pretty much the only option (especially nintendo. nintendo sucks at keeping their games most of the time.)

fixed it for you

now stop trying to do whatever you're doing. it's not working.

Do you have any proof (like, law-term proof not “my source is that i made it all up” proof) of that?

Touché. It is still illegal, even if the game is lost to time until the Switch U Cube 64 Entertainment System may releases in 2056 with 3DS Virtual Console for $69.99/month. It is illegal. We arrn't pirates, or are we? Just make your own. Like, even that guy PolyMars did that with Terrifried! (even though i think this is just the Splatoon 1 arcade game with textures changed)

Man I wake up and come to this thread expecting discussion about how cool new 3ds mods are, emulation on the console, its games, features, how to repair it, etc. but all I see is discussion around whether or not it's legal to download games. It's getting tiring considering this is the only thing we've really talked about since like page 39.
