Is this project legal?
Well…it's rather unlikely that Namco would find this an obstacle in their financial concern, cause they are already shredding money from people (look at their PacMan app for iOS - want to play this map? That'll be $0.99. That's in American dollars, too. Multiply that by 1.2 and you have a deal.) When you look at for-profit companies, they just want money. If money were biscuits, the top software companies would need a rather large warehouse to store it all. So, if you make a few thousand dollars a day (or more), would it be of concern if a child made their own version of your game? Hopefully not, and they'd be really happy if you incorporated their idea (of course, with permission)?

Well, I'd hope that is taken into account on both sides of this argument, and that a negotiation is made soon.

Is this project legal?
Since “Fair Use” states that the project is allowed because it is for educational purposes, could the creator actually sue NOMco?

Yep, no lie. There's a copy of their DCMA takedown notice somewhere on the internet if you want to read it.Apparently they though a ten year old's Pac-Man project is a threat to their finances and economic well-being.Really?

No, but the creator could theoretically legally challenge it if they wanted to. Since “Fair Use” states that the project is allowed because it is for educational purposes, could the creator actually sue NOMco?

LOL you burned Namco XDNamco-Bandai forced us to censor a project because Namco-Bandai didn't like people using their characters. Apparently they though a ten year old's Pac-Man project is a threat to their finances and economic well-being. Hey,
I heared that a scratch game (“Pac-Man”) has been deleted cause the Pac-Man developer doesn't agree with it.
Could the same thing happen with my project? The game idea has nothing to do with the original pac-man.
If yes, do i just have to rename the game? or also to redesign the game character? D':

Honestly, we believe it was a case of Fair Use, and we're not going to remove your Pac-Man project (or any other project for that matter) just because Namco-Bandai forced us to censor one. Whether or not Namco-Bandai is going to be come all huffy again and demand removal of your project is another question.![]()

Since this topic hasn't seen a new post from the topic owner in a long time, I'm going to assume that it is dead and close the topic. If it still is alive, the topic owner just needs to use the Report button to ask a mod to reopen it
