They are restricted. The actual FNAF games are banned, and any other types of FNAF games or spinoffs that don't follow the community guidelines. However, you are welcome to use the characters from the game to make a dress-up game, or something along those lines.
Most FNAF games are too scary for younger children, so that's why they aren't allowed. There really aren't situations in which a dress-up game would be scary, so that's why it's allowed, even if you use the characters.

… But what if its a remix but dosen't actually work(No jumpscares, to broken to work…)?

I'd probably just report the original, and include an extra note and link to the broken remix so that the ST can do what they think is best with it. I'm not necessarily saying that's the best option, but that's what I'd do. … But what if its a remix but doesn't actually work(No jumpscares, too broken to work…)?
If the original has already been taken care of, and the remix is really that broken, It would probably depend on the situation. There might be a sprite that's still WAY too scary, but if there's nothing particularly intimidating inside the project, you can probably just leave it.
NOTE: This is not in any way ST-sponsored advice, imo you just kind of have to go with your gut on this one. Hopefully an actual ST member will pop in and provide some input, but until then/if that doesn't happen, the advice above is probably pretty safe.

are FNAF games banned in scratch?
FNAF games are not banned from Scratch as Candylanguagegirl said, but are two restrictions (from the Scratch Team, the moderators of Scratch) have been enforced/concerned.
1. COPYRIGHT - Direct simulations/identical games may raise copyright issues and may anger the FNAF creator(s.) Inspired games are allowed, however.*
2. MATURITY/APPROPRIATENESS - FNAF contains a crucial element that is not entirely allowed on Scratch - jumpscares. Jumpscares may be fun to older and intense players, but Scratch is designed to be used by all ages. These “scary” elements are able to be reported and removed. You can make somewhat-creepy FNAF projects, but not too far (no gore or jumpscares.)
Thanks for reading,
Austinato
*The Scratch Team does not approve projects that are direct copies of copyrighted ones for Featured Projects already.

FNaF isn't technically banned, but the game doesn't follow the community guidelines. It's scary, creepy, and both of these are not allowed. Scratch is for all ages, so there's even a chance that someone 1 year old will click on a FNaF game and be scared by it. If you can find a way to make it not scary, then that's fine. FNaF itself isn't what's banned, it's the genre. It's a horror game. Scary/creepy things aren't allowed.
Hope this helps!

Wrong. Yes. FNAF is banned in everything except name.
FNAF projects are allowed as long as there are no scary content or anything.
The only project that resulted in a DCMA takedown was the Pac-Man project. 1. COPYRIGHT - Direct simulations/identical games may raise copyright issues and may anger the FNAF creator(s.) Inspired games are allowed, however.

Even though jumpscares are not allowed, you can still make a fangame with FNaF characters. What I did is replace the moment where it would happen with a death stare from Freddy.

Yes, but if someone wanted to make "Dress up FozzyFreddy", that would be allowed, since there is nothing bad about that. And FNAF is a scary game.Wrong. Yes. FNAF is banned in everything except name.

Exactly. Since fozzy is from the Muppets and not FNAF. I think you mean the titular chartor Freddy. Also just having the chartos in something thats not related to there original thing count as banned in all but name.Yes, but if someone wanted to make “Dress up Fozzy”, that would be allowed, since there is nothing bad about that. And FNAF is a scary game.Wrong. That is the stupidest thing ive ever heard. “Fnaf Games Are Okay As Long As Theyre Not Scary”? Are you serious? Whats the point of a horror game if its not…horror? You need to check yourself scratch, either ban it, or dont ban it. The only thing I hate more, is when people dont make up theyre mind.

The point here is that horror games that aren't age appropriate are banned from Scratch. So if we're talking about a project with jumpscares, then that probably would not be ok. But what about a Freddy Fazbear dress up game? That's probably ok. The bottom line here is that any project that violates the Community Guidelines isn't ok for Scratch. Please see this topic for the Scratch Team's reasoning on the matter. Although the discussion has been closed there, you can still use the Contact Us page if you have any further questions.

FNAF games are banned if you make them violent or to scary, but if you just use the characters for something fun and not violent or scary, then fine, make a game with FNAF characters.
