Sans spits up blood through his mouth.
The only way that this is possible is which the blood goes up through the neck.
But then it would leak through if Sans didn't have a neck.
In a No-Mercy run, Papyrus doesn't even know what you are.

And after all, you never actually see him disintegrate in screen, he walks off.

But you gain an LV when he goes off screen so, yeah. He's dead.
Also, if Sans was a human, he'd have the ability to SAVE, due to his determination.
But he said himself that he couldn't.
