Copy righted music. :/

Are you allowed to have copyrighted music in your scratch project?

I am making a Star wars project and need their score, Just a question to be secure, am I allowed to put music in my scratch project that isn't mine?

Yes. Scratch has a special license that lets you use copyrighted music.

I've seen this misinformation be gives so many times, by so many people. The CC license lets other people use work protected under it. For works under normal copyright, the fact that Scratch is an “educational site,” so therefore the use is “fair use” is the reason many Scratchers use to say that using copyrighted works is allowed.

Well, its partially that. Scratch is actually a hybrid “by-passer” of the copyright because of two things-
1. The fair use.
and
2. The License.

I read the license, and it never said anything about the license using work protected under it.

But in either case, please give credit.

Although there is a way to download the music and then convert it to a format where it can be played on virtually any device.
And I've tried to convert to .wav before, but it's difficult (still haven't figured it out, kind of annoying me)

I have had this question for a while, and I've realized that since so many people are doing it and only 2 have been taken down, it's safe to use copyrighted works as long as you give identification and a link to the owner of the music/images/ideas.

You are allowed to use copyrighted music just as long as you give credit. Technically, not giving credit to scenarios of using music is a violation of the CC, which is a copyright license given to Scratch.

Outside of music, if you make a direct remake of something, it may be asked to be removed by the original developers.

The CC has nothing to do with it - that's merely the license you are sharing your original content under. Any copyrighted content can technically be protected by fair use on Scratch, but because nobody on Scratch is a lawyer it's hard to say exactly what is allowable and what isn't.

And yes, the Scratch Team will generally take action against a project if the copyrighted holder issues a DMCA, but this rarely happens - effectively, the reason you're allowed to use copyrighted stuff, like music, is because nobody bothers to try to take it down.

Just gonna add on to here…

The Fair Use argument here is that you're using the copyrighted content for educational purposes (in this case, learning to program). There have been two cases where copyright holders asked Scratch Team to remove or change content - NAMCO for a Pacman game (this was weird because they only went after one Pacman game) and some other entity wanted a studio's name changed.

If you're worried about getting sued, though, don't. You're a kid who's making games at no profit on an educational website sponsored/created/etc. by MIT. If anything, you're promoting the copyrighted content you use.
