Alright, this is an important question I have that I want to have answered sometime.

Bingo is a Scratch Mod that was created by LS97, based off of Scratch 1.4. It has a nice feature: exporting to .exe. I was planning on making a project that I could sell, because the Scratch FAQ says “if it is not shared here you can sell your Scratch projects” but when I read further, in the mod, it showed the Scratch modding terms and conditions.

Here's what it says:

Permission is granted to… or distribute the Software or the software derived from it (“Derivitave Works”) for non-commercial purposes.

Is this at all different? Or does it mean I can only sell my Scratch projects (meaning there is little to no value in it, since there is no .exe converter for the .sb2 format).

I remember this question was asked and answered once before on the old forums, and so i'll try and explain what the official position is.

Selling the Scratch software itself is illegal. This means you cannot charge people to download Scratch, in the form of an installer, or ready-made, for any platform. I don't think you can sell mods either.
If your project has never been shared on the website, there is still no license attached to it. That means you can attach whatever license you want to it, even a proprietary one. So, you can charge people to download the project file from your website, or to buy a CD with it on. You can even include Scratch on the CD, as long as that is not included in the price.
And if you happen to make any money from selling Scratch projects, you are encouraged to donate to Scratch.

As for selling the EXE, the same rules apply. I think that the EXE contains a compiled version of Scratch (or Bingo, or whatever) with it, so be careful not to charge for that component.

Hmmm… but the compiled version of Bingo is not extractable, or even viewable, it is rather tied to the project. Or, on the other hand, I think it turns it into a .exe, but I don't know.

What if your project has been shared to Scratch, but you decide to unshare and then sell it? You can still do that, right…?

And how do you donate money to Scratch? That'd be an interesting thing to know.
